NHS Constitution

The NHS Constitution brings together the principles, rights and responsibilities that underpin the NHS. It forms the basis for the relationship between staff, patients and the public where everyone knows what they can expect and what is expected from them

Introduction

The Constitution is the result of extensive consultation with staff, patients and the public held in the autumn of 2008.  A similar process was then undertaken in respect of the introduction of new rights to the Constitution. NHS Lincolnshire consulted with various stakeholders, viewpoint panel members and the public to gain their views and the following report outlines the feedback received.

Key Messages

  • There was majority support for a right in respect of waiting times to be included in the NHS Constitution
  • The majority of respondents agreed that the right should include the current standard for treatment within 18 weeks and the current standard for urgent referrals of suspected cancer to be seen by a specialist within two weeks
  • Most believe that GPs should provide specified information to patients on their rights around a two week referral
  • Most felt that a right to an NHS Health check every five years for those aged 40-74 should be established and be included in the NHS Constitution
  • There was support for the exploration of the majority of potential future rights for patients and the public in a number of areas
  • Only slightly more respondents agreed that the role of the Constitution champion should be determined locally by PCTs than disagreed

Waiting Times - Your Right

Section 2.a of the NHS Constitution sets out the following right for patients:

You have the right to access services within maximum waiting times, or for the NHS to take all reasonable steps to offer you a range of alternative providers if this is not possible. The waiting times are described in the Handbook to the NHS Constitution.

This means patients have the right to start consultant-led treatment within 18 weeks from referral, and to be seen within two weeks of GP referral for suspected cancer or, where this is not possible, for the NHS to take all reasonable steps to offer a patient a quicker appointment at a range of alternative providers if the patient makes such a request.
